The Indian is not identified. Being Oregon, he is certainly not Apache so may be Plains.; possible a Scout. He has a wide brim western hat and "whiteman cloths". He has a Colt SAA stuck in his pants and he is holding a lever action rifle that I cannot identify in the picture. I know Winchesters VERY well but does not look like one.
